Marion Court System & Jurisdictions

Marion County is part of Iowa's 5th Judicial District. In Iowa, there are no separate specialized courts at the county level — the District Court is a court of general jurisdiction that handles virtually all categories of cases.

Types of Cases Handled by the District Court

  • Criminal Cases — from felonies to misdemeanors and serious traffic offenses.
  • Civil Cases — claims for any amount, including contract disputes, debt collection, and damage claims.
  • Family Cases — divorce, child custody, alimony, protective orders.
  • Probate Cases — estate administration, appointment of guardians, property management.
  • Juvenile Cases — juvenile offenses, child protection.

The Magistrate Division — a division of the same District Court — handles minor cases.

  • Small Claims — claims up to $6,500.
  • Simple Misdemeanors and scheduled traffic violations.
  • Preliminary Hearings in criminal cases and issuance of search warrants.

If you are unsure which division your case belongs to, contact the court clerk at 641-828-2207.

How to Get a Copy of a Marion Court Document

Copies of court documents are issued by the Marion County Clerk of Court's office. There are two types of copies:

  • Certified Copy — has an official stamp and the clerk's signature. Required for legal procedures: filing with another court, confirming a decision, processing documents.
  • Uncertified Copy — a regular copy for review.

Ways to Obtain

  1. In Person — visit the clerk's office on the 3rd floor of the courthouse. Business hours: Mon–Fri, 8:00–16:30.
  2. By Mail — send a written request specifying the case number, parties' names, and type of document.
  3. Through the eFile System — registered users of the Iowa electronic filing system can view documents in cases they are a party to and download copies.

For mail requests, send a letter to:

Some records have restricted access — juvenile cases, sealed criminal cases, and certain family cases are usually not public. Check with the clerk if the document you need is available. Access rules to court records are governed by Chapter 20 of the Iowa Court Rules.

Divorce records are also kept by the court clerk, not the Recorder's office — this is a common misconception clarified by the Recorder's office FAQ.
